Terms of Use

These Terms of Use ("Terms") are an agreement between you and J. G. DE JESUS SOFTWARE, CNPJ 62.353.888/0001-01 ("Café District", "we", "us"), the company that makes and runs the game Café District at cafedistrict.app. By playing Café District or using this website, you agree to these Terms. Our Privacy Policy explains how we handle your personal data.

1. What Café District is

Café District is a free game you play in your web browser: you run a small café, serve guests, decorate, hire staff and grow a garden. This website tells you about the game and holds its legal documents and our contact details.

2. Who can play

You must be at least 13 years old to play. If you are under 18, or under the age of majority where you live, you may play only with the permission of a parent or legal guardian. They accept these Terms on your behalf, give any consent the game asks for, such as allowing us to quote your feedback, and are responsible for how you use the game.

Café District is not directed at children under 13. If you believe a child under 13 is playing, email privacy@cafedistrict.app and we will delete their café.

3. Your café and your account

• Playing as a guest. When you open the café, we create a guest account for you and keep your café on our servers. Only the browser you play in can open a guest café. A guest café that nobody opens for 30 days is deleted, with everything in it.
• Keeping your café. You can link your café to an email address — we send you a one-time code, and there is no password — or, where offered, to a Google account. Then you can open it on any device, and it is not deleted for inactivity.
• Your email. Anyone who can read your email can sign in to your café. Keep your email account secure, and write to support@cafedistrict.app if you think someone else has signed in.
• One person, one account. Your account is personal. Do not share, sell or transfer it.
• Friends. You can add friends with a friend code or an invite link. Your friends see your café's name, avatar and level, can visit your café, and can help in it within daily limits; you can do the same in theirs. You can remove a friend at any time. Reporting a friend's café name also blocks them: you stop being friends, and neither of you can add the other again.
• Your café's name. You choose it, and it must follow the rules in Fair play. We may hide a name from other players, reset it or stop it from being changed when it breaks them.
• The Global Market. From a certain level, a café linked to an email or Google can put goods it holds up for sale to other players, at a price the seller chooses within limits the game sets, and buy what other players put up. Other players see your café's name and avatar beside your goods, their amounts and prices. A purchase is final. Everything on the market is bought and sold with coins earned in the game. No real money is ever involved, and coins from a sale cannot be withdrawn or exchanged for money. The game itself also sells some goods on the market, in larger amounts, for coins. The market keeps a fee from each sale, shown before you list; a listing that does not sell comes down after a while and the goods come back. The market has daily limits. You can also sell goods straight back to the game at a fixed price. Reporting a seller's café name also blocks them: neither of you sees the other's goods again.

4. Coins, gems and other items in the game

Coins, gems, recipes, furniture, decorations and everything else you earn or place in Café District are part of the game. They have no monetary value and cannot be exchanged for money or for anything outside the game. Inside the game, you may sell goods you hold to the game or to other players on the Global Market, for coins; apart from that, nothing can be sold or transferred. We grant you a limited, personal license to use them while you play.

Items in the game are bought with coins earned in the game, and premium looks with gems. Gems are earned in the game, from levels, quests and other rewards, and are spent on premium looks, which change how your café looks and never what it earns, and on refreshing tired staff. Gems never turn into coins, and a premium look cannot be sold. If you start a new café, it starts from nothing: gems and premium looks included. Helping a friend pays a small, limited reward each day, and inviting friends is rewarded through the game's quests, like any other quest. Nothing is sold for real money in Café District today. We tune the game as it grows — prices, timers, rewards and what an item does can change — and we may correct items or progress that came from a bug or from breaking these Terms. If we ever start selling anything, we will update these Terms first.

5. Ratings, feedback and quotes

You can rate Café District and send us written feedback, in the game or on this website.

• You keep the rights to what you write. You allow us to store it and read it to answer you and improve the game.
• Once enough players have rated the game, we show the average star rating and the number of ratings in the game and on this website.
• We quote your words publicly only if you tick the box that allows it, and only after we have reviewed them. A quote shows your stars and your café's level — never your name or your email. We may shorten a quote, but never change its words. You can ask us to remove a quote at any time by writing to privacy@cafedistrict.app.
• Do not put personal data in feedback, yours or anyone else's, and do not write anything unlawful, hateful or abusive. We may delete feedback that breaks these rules.

6. Fair play

You may not:

• use bots, scripts or other automation to play, or send requests to our servers other than through the game;
• exploit bugs, cheat, or change the game's code or data to gain progress;
• create several cafés or accounts to collect extra rewards, including invite and help rewards;
• trade on the Global Market between your own accounts, or arrange trades with other players, to move coins or goods around the game's limits;
• buy, sell or trade anything from Café District, including coins, goods and accounts, for money or for anything outside the game;
• give your café a name that is offensive, hateful or sexual, that contains personal data, or that pretends to be Café District, its staff or another person;
• report café names falsely, or to harass another player;
• try to get into another player's café or account, or into our systems;
• disrupt the game or its servers, for example by overloading them;
• use Café District for anything unlawful.

7. Our game and its content

Café District — including its software, art, music, characters, names and design — belongs to J. G. DE JESUS SOFTWARE or to those who licensed it to us. Some sounds and music are used under their own free licenses and are credited in the game. We grant you a limited, personal, non-transferable right to play the game under these Terms. You may not copy, sell or redistribute it.

8. Availability and changes

We work to keep Café District available, but we do not promise that it will always be available, free of bugs or unchanged. We may add, change or remove features, and we may suspend or end the game. If we decide to shut Café District down, we will announce it in the game and on this website at least 30 days in advance.

9. Ending your use

You can stop playing at any time, and you can delete your café and your account from the game's settings. Deletion works as described in the Privacy Policy.

We may suspend or delete an account that breaks these Terms, or when the law requires it. Where it is reasonable, we will tell you first and give you a chance to respond.

10. No warranty

Café District is free of charge. We provide it as it is and as available, and we give no warranties beyond those the law requires.

11. Limitation of liability

To the extent the law allows, we are not liable for indirect losses, or for the loss of progress, items or data in the game, except where the law holds us responsible. Nothing in these Terms limits our liability for intent or gross negligence, or any other liability or right that the law does not allow to be limited, including your rights as a consumer.

12. Changes to these Terms

We may update these Terms. When a change is important, we will tell you in the game or on this website at least 30 days before it takes effect. If you do not agree with the change, you can stop playing and delete your account at any time; if you keep playing after it takes effect, the updated Terms apply.

13. Governing law

These Terms are governed by the laws of Brazil. The courts of Salvador, State of Bahia, Brazil, have jurisdiction over any dispute arising from these Terms — without prejudice to the mandatory consumer protection rules of the country where you live. If you are a consumer, you may bring a claim in the courts of your own domicile, and we may bring a claim against you only in those courts.

15. Language

These Terms are written in English and are also offered in Portuguese and Spanish. If a translation differs from the English version, the English version governs, unless the law where you live gives priority to the version in your language. For players in Brazil, the Portuguese version governs.
